FY2025 H-1B Cap Non-Immigrant Worker Petition: Key Information and Guidance

Litwin & Smith, a leading law firm in H1-B Visas and immigration services, is dedicated to assisting employers with the H-1B visa process.

The H-1B visa enables U.S. employers to temporarily employ foreign workers in specialty occupations, and for new candidates, an employer pre-registration is required.

Increased Complexity in H-1B Petitions The H-1B petition process has grown in complexity, demanding more detailed documentation to prove the specialty nature of the position offered. With our proven track record of success, Litwin & Smith stands ready to guide employers through this meticulous process.

Why Choose Litwin & Smith We are the most frequently chosen firm for employer-sponsored U.S. employment authorization, known for our high success rate in obtaining H-1B approvals and subsequent immigrant visas and green cards. Our commitment to excellent service, competitive pricing, and extensive expertise sets us apart.

Anticipated H-1B Lottery Trends The upcoming H-1B Lottery is expected to see fewer registrations, potentially increasing the chances of selection for applicants.

H-1B Cap Registration for FY 2025 Litwin & Smith is registering H-1B employers and beneficiaries for the FY2025 season, offering a flat fee of $600 per employer for up to four employees. Please be mindful of the annual cap of 65,000 visas and the requirement for electronic registration with a fee of $10 per submission.

Registration and Selection Dates The initial registration period for the USCIS Federal Register Implementation will open on March 1, 2024, and close on March 15, 2024. A random selection process will follow to determine the eligible candidates for filing cap-subject petitions.

Preparing for Registration We advise preparing H-1B Cap Registration filings in January or early February for the March 1st registration period. Selected registrations will have 90 days to file the H-1B petitions.

Change of Employer and Extensions For individuals with I-94 H-1B validity, a new employer can sponsor them and they may begin work upon USCIS receipt of the petition. Extensions are also possible, allowing the employee to continue working for up to 240 days after current I-94 validity expiration.

The H-1B Petition Process Litwin & Smith outlines a four-step process involving LCA preparation, petition drafting, submission with supporting documentation, and final adjudication and visa application. Our firm provides comprehensive assistance throughout each stage.

Specialty Occupation and Employee Qualifications To qualify as an H-1B specialty occupation, there are specific educational and professional criteria that must be met. We assist employers in navigating these requirements to ensure the qualification of the potential H-1B employee.

Wage Requirements and Labor Condition Application Employers must comply with prevailing wage requirements and are guided by our firm in determining appropriate wage levels. We leverage the DOL OES Wage Survey and other resources, providing a safe harbor wage option as well.

Employer’s Wage Responsibility Employers are responsible for ensuring the H-1B employee’s wage meets the required standards without bearing the costs of H-1B related fees, including the fraud fee and ACWIA training fee.

Fees and Costs Litwin & Smith offers a comprehensive service package for H-1B petition filing, including attorney fees and USCIS filing fees. We strive to expedite the process and offer premium processing options.
