Employment Based Processing Delays
We hear from a number of employers they continue to see horrendous processing delays for a number of employment-based benefits- including H-1B, L-1A/B, EB2 National Interest Waiver (NIW), and EB1.A Multinational Manager.
2017 H1B Cap
What about the H1B Cap backlogs? There are still 2017 H1B Cap petitions that are not adjudicated. There are a number of FY2017 H1B Cap Petitions for October 1, 2016, employment start date are not adjudicated.
The Vermont Service Center indicated in September that it had
completed a “first touch” of only about 75% of its H1B Cap cases. California Service Center processing times were similar in September.
USCIS Response:
USCIS is prioritizing and seeking to complete all H1B Cap cases as soon as possible.

USCIS is closely monitoring all employment based category workloads through reporting mechanisms and are re-allocating
resources as needed. USCIS is cognizant of the growing delays and doing its best to work on them.
