Bay Area Employment Visa Lawyer

We have experience helping employers and employees obtain the working visas they need to further their business capabilities. Our lawyers can help you understand and identify the most appropriate visa to meet your needs. The H E L O visas are the most common employment-based nonimmigrant visas (temporary work visas).

  • H visas : Temporary work visas for professionals (H-1B visas), agricultural or seasonal workers (H-2A and H-2B visas), and trainees
  • E visas: For treaty traders (E-1 visas), treaty investors (E-2) and Australian business professionals (E-3)
  • L visas : For intracompany transfers of foreign executives, managers or employees with specialized knowledge
  • O visas: For foreign nationals with extraordinary ability in the sciences, arts, education, business or athletics

In addition to our unequaled experience handling the H E L O employment visas, we are unsurpassed at preparing for filing petitions for religious workers (R visas), foreign exchange students (F visas), foreign exchange workers (J visas), professionals in technology and biotech industries and other professionals.

Obtain A Green Card Through Employment

We are very successful in preparing customized labor certifications and subsequent immigrant visas and green cards for employees; including those that require special attention. We prepare many of such petitions each year among the hundreds of those we prepare. Currently, the Department of Labor (DOL) is randomly auditing about 40% of the PERM labor certification filings. Although, we cannot guarantee our PERM filing will not be audited by the DOL. Our PERM filings are seldom audited. Maybe that is because we prepare our filings with an audit in mind. We perform all the steps along the way as if preparing for an DOL Audit Response. Unlike, most firms that only prepare an audit file after they receive an audit notice. Or just maybe it’s our reputation for paying attention to all the details that results in our lack of audits.

The PERM labor certification (LC) is the first in a three-step process in the majority of employment-based, permanent resident (commonly referred to as “green card”) cases. We enable our clients’ goals of immigrating to the United States and obtaining permanent residency status (green card) — and ultimately, citizenship. Our lawyers guide clients through all aspects of employment-based immigrant visa applications, including labor certification through PERM.
