ICE I-9 Audits Uptick

There seems to have been an uptick in I-9 Audit Notices recently. If your businesses is one of the businesses that received an I-9 Audit Notice, you are not alone. ICE HSI announced the results of a nationwide operation in which I-9 Audit Notices were served to more than 5,200 businesses since January 2018. During the first phase, HSI served 2,540 NOIs and made 61 arrests and during the second phase, HSI served 2,738 NOIs and made 32 arrests.
The administrative inspection process is initiated by the service of a Notice of Inspection (NOI) upon an employer compelling the production of Forms I-9. By law, employers are provided with at least three business days to produce the Forms I-9. Often, ICE will request the employer provide supporting documentation, which may include a copy of the payroll, list of current employees, Articles of Incorporation, and business licenses.
