President-Elect Trump what will happen to DACA

"When President-Elect Trump takes office what will happen to people with the DACA?"

This question is being asked in U.S. immigration forums everywhere. We at Litwin & Smith understand your anxiety and assure you that we advocate to protect persons with DACA.

While President-elect Donald Trump put immigration at the forefront of his campaign for the White House. And, Deferred Action is a program that in the administration's discretion may be terminated immediately. We cannot predict whether President-Elect Trump will revoke the Deferred Action For Childhood Arrivals Executive Order of President Obama.

Deferred Action for Childhood Arrivals

The Deferred Action for Early Childhood Arrival (DACA) program was established by the Obama Administration in order to allow undocumented individuals who were brought to the U.S. as children to obtain work permits. This policy will likely attract the immediate attention of the Trump administration because of its concerns that the Obama administration violated the U.S. Constitution by establishing the policy without following rule making procedures. Despite a grant of DACA, a recipient is still subject to deportation proceedings should the Department of Homeland Security (DHS) decide to deport him or her from the United States. If such were to occur, they are entitled to hearing before an Immigration Court. Don't wait for a Notice To Appear for a removal hearing before an Immigration Court.

Individuals who have been granted DACA should call 650 588 7100 to consult with experienced immigration counsel to understand their rights and options to remain in the U.S. to obtain a lawful status.
