EB5 Continues Until September 30, 2018

The Congress approved spending package and continuing resolution extends the EB-5 program until September 30, 2018. The extension maintains the EB-5 Regional Center Program rules as-is, including the investment amounts of $500,000 for Targeted Employment Area (TEA) markets.

Whether regulatory changes to the EB-5 program, including new Integrity Measures as well as a Substantial Investment Increases, potentially to $1.8m, will be implemented remains to be seen. While comments received by DHS were uniformly against the investment amount increases it is reasonable to anticipate new regulations to include investment increases to $900k - $1,200,000.

Anyone considering the EB-5 program as a means to earn permanent US residency, should consider retaining an immigration attorney and begin the process of getting their documentation in order to take advantage of the current rules rather than wait for the new rules to be published by DHS.
